Terms, refunds and privacy

This page explains who sells Performers Assistant, what you receive, how cancellation and refunds work, and how personal information and optional integrations are used. It applies to the Performers Assistant for Mac and Windows beta sold through this website.

Terms of sale and software licence

Performers Assistant is a local-first desktop application for Mac and Windows for managing performance enquiries and bookings. The price and features shown on the purchase page form part of your order. Payment is a one-time payment in pounds sterling and is handled securely by Stripe.

Your one-time purchase gives you a licence to use Performers Assistant for Mac and Windows forever for version 1. The app does not require activation or a device login. You may not resell, share, rent, reverse engineer or distribute the application, except where the law gives you a right that these terms cannot restrict.

Your purchase includes compatible Mac and Windows downloads and updates throughout desktop version 1. A significant future version may be a separate purchase, with a reduced upgrade price for existing customers.

The beta is supplied for testing in real working conditions. Any known installation warnings or platform limitations will be shown before download. Beta status does not remove your statutory rights.

Offline use and refunds

An internet connection and a Performers Assistant account are required to purchase and download the application. Once installed, the app works without a login or licence check. If a payment is refunded or disputed, we stop further downloads, but we cannot remotely switch off an installed copy.

Cancellation and refunds

Before digital content is supplied immediately, you will be asked to expressly request immediate supply and acknowledge that your ordinary 14-day right to cancel will be lost once the download is made available. If you do not agree, do not continue with the immediate digital purchase.

We may offer a voluntary change-of-mind refund before the application has been downloaded or set up. After immediate supply has begun with your express agreement and acknowledgement, a change-of-mind refund is not normally available.

Nothing here limits your rights when digital content is faulty, not as described or does not do what it is supposed to do. Contact us first so we can investigate and, where appropriate, repair, replace, reduce the price or refund you as required by law.

Your statutory rights

You have rights under applicable consumer law, including the Consumer Rights Act 2015. These terms do not exclude or restrict rights that cannot legally be excluded. Guidance is available from Citizens Advice.

Privacy notice

Kristien Harris trading as Performers Assistant is the controller of the personal information described in this notice. Privacy questions and requests can be sent to support@performersassistant.com.

Information we use

We use your account email and authentication records; opaque purchase and payment references; download and security records; and messages you send to support. Stripe receives the payment details needed to process your purchase. We do not receive or store your full card details.

Your enquiries, bookings, customer details, documents, templates, branding, financial settings and backups stay in the desktop application's local storage unless you deliberately use a connected website-form provider or another export or integration.

Connected form providers

You can optionally connect a supported form provider, currently Google Forms, Netlify Forms, Jotform, Tally or Fillout. When you choose to connect one, the desktop application communicates directly with that provider using the account permission or API credential you supply. It reads submissions from the form you identify, including submitted answers, submission identifiers and times, and the provider's available field information. Where the provider supplies question titles, the application displays them so you can map questions without interpreting internal question IDs. Performers Assistant does not edit or delete your form or its responses.

Connection credentials and renewable Google authorization tokens are stored in macOS Keychain or Windows Credential Manager on your computer. They are not stored in the Performers Assistant account service, booking database, backups or exports. Imported submissions become local enquiry records under your control. Performers Assistant does not upload your local edits, bookings or customer records back to the form provider, and the operator of Performers Assistant does not receive the form responses through this integration.

The form provider continues to hold the original form and responses under its own terms and privacy notice. You are responsible for choosing appropriate form settings, providing any privacy information required to people completing your form, having a lawful basis for collecting their information, and mapping imported fields accurately. Disconnecting a provider removes the local connection but does not delete information held by that provider or enquiry records and backups already stored on your computer.

Information received from Google APIs is used only to provide the visible Google Forms connection, field-mapping and enquiry-import features requested by you. It is not sold, used for advertising, used to build advertising profiles or used to train general-purpose artificial-intelligence models. It is not transferred to others except where necessary to provide the user-facing feature with your direction, for security purposes, to comply with law, or as otherwise permitted by the Google API Services User Data Policy. People do not access Google user data unless you ask for support and give permission, access is necessary for security, or the law requires it.

Sharing, transfer and disclosure of Google user data

Performers Assistant does not share, transfer or disclose Google user data to the operator of Performers Assistant, its account-service providers, advertisers, data brokers or other third parties. The Google Forms API sends the selected form's question information and responses directly to the desktop application on your computer. The application stores imported responses locally for you and does not send them to the Performers Assistant website, Supabase, Netlify, Cloudflare, Stripe or any other service provider.

Google user data leaves the application only when you deliberately direct it to, for example by exporting or sending information yourself; when you provide specific information to us while requesting support and give us permission to examine it; when limited disclosure is necessary to investigate a security incident; or when disclosure is required by law. We do not permit recipients to use Google user data for advertising, sale, profiling, data brokerage, credit decisions or training general-purpose artificial-intelligence or machine-learning models.

Protection of Google user data

Performers Assistant protects Google user data by requesting read-only Google Forms access and using OAuth 2.0 Authorization Code flow with PKCE. Connections to Google's authorization and API services use HTTPS encryption in transit. Renewable OAuth tokens are stored in your operating system's credential store rather than in the application's database, preferences, logs, backups or exports.

Form responses and question information are processed locally on your computer. Imported responses are stored in the application's local database under the access controls of your operating-system user account; they are not placed in the Performers Assistant account service. You are responsible for protecting access to your computer and any local backups, including using a strong device password and device encryption where appropriate. You can revoke Google access from your Google Account, disconnect Google Forms in the application, and delete imported enquiries and backups you control.

Why we use it

We use account and purchase information to perform our contract with you: creating your account, taking payment, providing downloads and supporting your purchase. We use limited security and audit records for our legitimate interests in preventing fraud, protecting the service, diagnosing faults and keeping reliable transaction records. We retain information where necessary to meet legal, tax and accounting duties.

Service providers and international transfers

We use carefully selected providers to operate the service, including Stripe for payments, Supabase for accounts and purchase records, Netlify for the website and account functions, Cloudflare for bot protection and private download storage, and email-delivery providers used by the account service. These providers process limited information under their own terms and data-protection commitments. Some processing may take place outside the UK; where required, we rely on recognised adequacy arrangements or contractual safeguards.

Google Forms, Netlify Forms, Jotform, Tally and Fillout are optional services selected and controlled by you rather than subprocessors used to host the Performers Assistant account service. The desktop application sends requests directly to the provider you connect. Each provider may process form-owner and respondent information internationally under its own terms, privacy notice and account settings.

Retention and your choices

We keep account and licence information while your account and purchase remain active. We may retain minimum purchase, refund, fraud-prevention, security and accounting records after closure where required by law or needed to establish or defend legal claims. Retention periods should be no longer than necessary for those purposes.

You can disconnect a form provider from the Forms settings in the desktop application and can separately revoke access in the provider account. You control deletion of imported enquiries and local backups. To delete or obtain copies of the original form submissions, use the controls supplied by the connected provider.

Depending on the circumstances, you may ask for access, correction, deletion, restriction, objection or portability of your personal information. You may also complain to the Information Commissioner's Office. Contact us using the details above to exercise a right.

Availability and responsibility

We take reasonable care to provide the application and account service as described, but cannot promise that every optional third-party service, internet connection or version of macOS or Windows will always be available. We do not exclude responsibility where doing so would be unlawful, including responsibility for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

You are responsible for checking imported form mappings and enquiry details, booking details, estimates, routes, calendar conflicts, invoices and messages before relying on or sending them, and for keeping suitable backups of your local business records. Your use of a connected form provider is also subject to that provider's terms, availability, permissions and account limits.

Changes, governing law and complaints

We may update these terms for future purchases or to reflect legal and service changes. The terms supplied with your purchase continue to govern that purchase unless a change is required by law or you agree otherwise.

These terms are governed by the law of the part of the United Kingdom in which you live. If you live elsewhere, mandatory local consumer protections may also apply. Please contact us first with a complaint so we can try to resolve it.
